The E-2 Treaty Investor Visa: Running Your Own Business in the United States
For entrepreneurs from Mexico and other treaty countries, the E-2 visa is one of the most direct ways to live in the United States and run a business you own. It is built for people who invest real money in a real company and then come here to direct it. Because Mexico is an E-2 treaty country, this visa is a workhorse for founders and investors across South Texas.
At Lozano Law Firm, E-2 cases are prepared under the direction of Alfredo Lozano, Board-Certified in Immigration and Nationality Law. Our bilingual team builds the business plans, source-of-funds records, and consular filings that E-2 approvals require, for clients in San Antonio, Eagle Pass, and San Angelo. Real Clients, Real Testimonials
Gracias por el excelente trabajo y por la tranquilidad que me han dado durante este proceso. Sin duda los recomendaría a familiares y amigos que necesiten un abogado de inmigración.
E-2 Requirements and How We Prove Them
The E-2 has no fixed dollar minimum, which is a blessing and a trap. It means a modest business can qualify, but it also means every element must be documented carefully, because officers exercise real judgment.
A Treaty Country National
You must be a citizen of a country that has the right treaty with the United States, and Mexico qualifies. The business must also be at least fifty percent owned by nationals of the same treaty country. We confirm nationality and ownership at the outset.
A Substantial, At-Risk Investment
The investment must be substantial in relation to the cost of the business, committed, and genuinely at risk. Money sitting in a bank account is not enough. We document the funds going into leases, equipment, inventory, and operations, and we trace where the money came from.
A Real Operating Enterprise
The business must be a real, active company that produces goods or services, not a passive investment or an idle shell. It should also be more than marginal, meaning it has the present or future capacity to generate more than just a living for you. A credible business plan carries a lot of weight here.
Develop and Direct
You must be coming to develop and direct the business, usually shown through majority ownership or a controlling managerial role. Key employees with specialized skills can sometimes qualify for their own E-2 status under the same company.
The Investors We Represent
Our E-2 clients are entrepreneurs putting real money and effort into U.S. businesses, from restaurants and franchises to technology and import ventures. Many are moving their families to Texas and want the visa handled in a way that supports the business plan rather than complicating it. We help investors organize their enterprise and their records so the application tells a coherent story, and we stay available as the business grows and the visa comes up for renewal. For families building a life here, we keep the guidance clear in English and Spanish at every step.
Our Process
What to Expect
Free Case Evaluation
We start with a no-cost consultation to review your situation, explain your options, and identify the strongest path forward for your family.
Case Preparation
Our team assembles your petition with the documentation and evidence USCIS expects, prepared accurately the first time to avoid delays.
Filing & Follow-Through
We file, track deadlines, respond to USCIS, and prepare you for every interview until your case is resolved.
The E-2 Process and What to Expect
Most E-2 cases for Mexican nationals run through the U.S. consulate rather than USCIS. We assemble the application, the business plan, the financial and source-of-funds evidence, and the ownership documents into a single persuasive package, then prepare you for the consular interview.
The E-2 is a nonimmigrant visa, so you show intent to depart when your status ends, but it can be renewed again and again for as long as the business continues to qualify, which is why many families build long-term lives on it. Approval periods and validity vary by nationality and consulate. In our experience, the strongest E-2 cases are the ones where the money trail and the business plan tell one clear, consistent story.

E-2 Treaty Investor Visa FAQs
How much do I need to invest for an E-2 visa?
There is no official minimum. The investment must be substantial in relation to the total cost of the business and enough to make it operate, so a smaller, lower-cost business can qualify with a smaller investment. Smaller investments do face more scrutiny, and strong documentation of the funds and the business is essential.
Is Mexico an E-2 treaty country?
Yes. Mexico has the treaty relationship required for the E-2, so Mexican citizens who meet the other requirements can qualify. This makes the E-2 a very common tool for entrepreneurs in our border region.
Can the E-2 lead to a green card?
The E-2 itself is a nonimmigrant visa and does not directly grant permanent residence, but many investors later pursue a green card through other paths, such as an employment or investor category. We plan the E-2 with your long-term goals in mind rather than in isolation.
Can my spouse work on an E-2?
Yes. The spouse of an E-2 investor is generally authorized to work in the United States, and children can attend school. This family flexibility is one of the E-2's biggest advantages.
How long is an E-2 visa valid?
Validity depends on your nationality and the consulate, and each admission is granted for a set period that can be extended. The key point is that the E-2 can be renewed indefinitely as long as the business continues to meet the requirements, so many families maintain it for years.
