USMCA Professionals
The TN Visa: Fast Work Authorization for Mexican and Canadian Professionals
The TN visa is one of the best-kept advantages of North American trade. Created by the agreement now known as the USMCA, it lets citizens of Mexico and Canada work in the United States in specific professions, without the annual cap or the lottery that limit the H-1B. For qualified professionals, it can be one of the fastest routes to a U.S. job offer.
At Lozano Law Firm, TN cases are guided by Alfredo Lozano, Board-Certified in Immigration and Nationality Law. Our bilingual team prepares the offer letters and credential evidence that TN approvals require, for professionals and employers in San Antonio, Eagle Pass, and San Angelo. Real Clients, Real Testimonials
Gracias por el excelente trabajo y por la tranquilidad que me han dado durante este proceso. Sin duda los recomendaría a familiares y amigos que necesiten un abogado de inmigración.
How the TN Visa Works
The TN is powerful but narrow. It only works for specific professions and specific nationalities, and the paperwork has to match the rules exactly.
Who Qualifies
You must be a citizen of Mexico or Canada, and you must be coming to work in one of the professions listed under the USMCA, such as accountant, engineer, scientist, lawyer, teacher, or many others. Most listed professions require at least a bachelor's degree or specific credentials, and the job you are offered must genuinely fall within the profession.
A Qualifying Job Offer
The TN requires a U.S. employer's offer for a position in a listed profession. The offer letter must describe the role in a way that clearly matches the profession and confirm that you hold the required qualifications. A vague or mismatched offer letter is a common reason for refusal, so we draft it with care.
How Mexican Citizens Apply
Mexican citizens generally apply for the TN at a U.S. consulate and receive a TN visa. We prepare the credential evaluation, the offer letter, and the supporting evidence, then get you ready for the interview.
Family Members
Your spouse and children can accompany you in TD status. They may live and study in the United States, though TD status does not by itself authorize employment, which is a point we make sure families understand up front.
Professionals We Help Under the TN
We regularly assist Canadian and Mexican professionals, and the employers who want to hire them, in fields that range from engineering and accounting to healthcare and science. Much of our value is in the details, matching a role to a qualifying profession and assembling credentials that satisfy an officer without unnecessary delay. Because many of our clients live and work along the Texas border, we understand the rhythm of cross-border careers and prepare each professional and employer so an entry or renewal is handled with confidence. When questions come up mid-assignment, our bilingual team is close at hand.

TN or H-1B, and What to Expect
The TN's greatest strength is speed. Because there is no annual cap and no lottery, a qualified Mexican professional with a solid job offer can often obtain TN status far faster than waiting for an H-1B number. TN status is granted for up to three years at a time and can be renewed for as long as the professional work continues.
The trade-off is that the TN is a nonimmigrant category tied to temporary intent, so a professional who is actively pursuing a green card needs to plan carefully to avoid problems at renewal. We help TN professionals think several steps ahead, so a short-term work solution does not close off a long-term goal.

TN Visa FAQs
What professions qualify for a TN visa?
The USMCA lists specific professions, including accountants, engineers, scientists, lawyers, teachers, health professionals, and many others. Most require at least a bachelor's degree or defined credentials, and the job offered must clearly fall within the listed profession.
How is the TN different from the H-1B?
The TN is limited to Mexican and Canadian citizens in listed professions but has no annual cap or lottery, so it can be obtained quickly. The H-1B is open to any nationality but is capped and awarded by lottery for new cap-subject petitions. Many Mexican professionals use the TN to avoid the H-1B wait.
Can the TN visa lead to a green card?
It can, but it takes planning. The TN is a temporary category, so openly pursuing permanent residence can raise questions at renewal. We help TN professionals structure the move to a green card path in a way that protects their current status.
Can my spouse work on a TD visa?
Not automatically. Spouses and children can join you in TD status and can live and study here, but TD status by itself does not authorize employment. A spouse who wants to work would generally need a separate work-authorized status.
How long does TN status last?
The TN is granted for up to three years at a time and can be renewed repeatedly as long as the professional employment continues to qualify. There is no lifetime limit, which makes it a durable option for ongoing professional work.
