EB-5 Immigrant Investor Green Card Attorney in San Antonio, Texas
Investor Green Cards
The EB-5 Green Card: Permanent Residence Through Investment
The EB-5 program offers a path to a green card for investors who put capital into a U.S. business and create jobs for American workers. For families who have the resources and want permanent residence rather than a temporary visa, EB-5 can move the whole family toward a green card at once. It is also detail-intensive, especially when it comes to proving where the money came from.
At Lozano Law Firm, EB-5 cases are guided by Alfredo Lozano, Board-Certified in Immigration and Nationality Law. Our bilingual team coordinates with your financial and business advisors on the documentation EB-5 requires, for investors in San Antonio, Eagle Pass, and San Angelo. Start with a free consultation.

How the EB-5 Program Works
EB-5 has a few core requirements, and each one carries significant documentation. Getting them right is what separates a smooth case from a denial.
The Investment Amount
Under current law, the minimum investment is generally 800,000 dollars if the project is in a targeted employment area, and 1.05 million dollars otherwise. Because these figures and the program rules change over time, we confirm the current requirements before you commit any funds.
Job Creation
The investment must create or preserve at least ten full-time jobs for qualifying U.S. workers. How those jobs are counted depends on whether you invest directly in your own business or through a regional center project, which affects how indirect jobs may be included.
Direct Investment or Regional Center
You can invest directly in a business you help run, or through a designated regional center that pools investments into a larger project. Each has different tradeoffs in control, risk, and how jobs are counted, and we help you understand them before you choose.
Source of Funds
This is where most EB-5 cases live or die. You must document that the invested capital was lawfully earned, with a clear paper trail from the source to the investment. We coordinate closely with your advisors to build that record thoroughly.
How We Support EB-5 Investors
EB-5 clients come to us at very different stages. Some have already identified a project and need careful review before committing capital; others are entrepreneurs who want to invest in a business they will run themselves. In both cases the stakes are high and the documentation is demanding, so we focus on getting the source-of-funds record and the overall structure right from the beginning. We also keep the later stage in view, preparing investors for the petition to remove conditions well before it is due, so a life-changing investment leads to secure permanent residence rather than an avoidable setback.

What to Expect With an EB-5 Case
We prepare the immigrant investor petition with the full business and source-of-funds record. When approved and a visa is available, investors and their families obtain conditional permanent residence, valid for two years.
Near the end of that two-year period, the investor files to remove the conditions by showing the investment was sustained and the required jobs were created, similar in spirit to the conditional residence process in marriage cases. Timelines vary with visa availability and processing, so we set realistic expectations and keep the documentation airtight at each stage.

EB-5 Investor Green Card FAQs
How much do I need to invest for EB-5?
Under current law, the minimum is generally 800,000 dollars for a project in a targeted employment area and 1.05 million dollars elsewhere. These amounts and the program rules change over time, so we confirm the current requirements before you invest.
What is the difference between direct investment and a regional center?
With a direct investment you put capital into a business you help operate and generally must create the ten jobs directly. Through a regional center, your investment joins a larger project, and indirect jobs can often be counted. They differ in control, risk, and job-counting, and we help you weigh them.
Why is source of funds so important?
EB-5 requires proof that your invested capital was earned lawfully, with a documented trail from its origin to the investment. Weak or incomplete source-of-funds documentation is one of the most common reasons EB-5 petitions run into trouble, so we build that record carefully.
Does EB-5 give my family green cards too?
Yes. A successful EB-5 case generally provides conditional permanent residence for the investor, their spouse, and unmarried children under 21. This is part of what makes EB-5 attractive to families who want to immigrate together.
Is the EB-5 green card conditional at first?
Yes. Investors first receive conditional permanent residence for two years. Before it expires, you file to remove the conditions by showing the investment was sustained and the required jobs were created, after which you receive permanent green cards.
