How Military Naturalization Works

Two sections of the law provide the accelerated path, and knowing which one applies shapes the whole case.

Naturalization During Hostilities

Under Section 329 of the Immigration and Nationality Act, a person who serves honorably during a designated period of hostilities can naturalize without the usual years of permanent residence and physical presence. That period has been in effect continuously since 2001, so most current service members qualify under this generous rule.

Peacetime Naturalization

Under Section 328, a service member with at least one year of honorable service can naturalize with reduced requirements compared to civilian applicants. We determine which section gives you the strongest, fastest case.

Fees Waived and Streamlined Filing

Military naturalization applicants are exempt from the usual filing fees. The application relies on Form N-400 together with Form N-426, which certifies your honorable service, and we coordinate with base personnel offices to get that certification completed.

Benefits for Surviving Family

Special provisions also protect the families of members who die from service-connected causes, including posthumous citizenship and continued eligibility for certain benefits. We handle these sensitive matters with the care they deserve.

What to Expect

What to Expect, Including Overseas Service

We prepare the N-400 and the N-426 certification of service, then file with USCIS. Service members stationed abroad are not left out, because the process allows key steps, including the interview and the oath of allegiance, to be completed at U.S. embassies, consulates, and designated military installations overseas.

Even with the accelerated rules, good moral character and disclosure of your full record still matter, so we review your history before filing just as we would for any citizenship case. In our experience, the biggest delays come from an incomplete N-426 or a missed detail in the record, both of which careful preparation prevents.
